The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the South African and other copyright laws, and is the property of The Vanity Bag SA. The collective work includes works that are licensed to The Vanity Bag SA. Copyright 2017, The Vanity Bag SA ALL RIGHTS RESERVED. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with The Vanity Bag SA or purchasing The Vanity Bag SA products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with The Vanity Bag SA or to purchase The Vanity Bag SA products. To the fullest extent permissible,  pursuant to applicable law, The Vanity Bag SA disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. The Vanity Bag SA does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. The Vanity Bag SA does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise.

4.         Returns Policy
The Vanity Bag SA will gladly accept returns on any unused and unopened items, except for supplements, within 30 days of receipt. For hygienic reasons, to ensure the purity of our products we do not accept returns on opened or used merchandise. In some cases, Gift with Purchase items must be sent back unused and unopened with your returning items for a full refund to be processed. When we receive your return request, we will notify you. Your Gift with Purchase must accompany your return. For orders that we may not be able to fulfil completely, we reserve the right to substitute items with a suitable alternative. The Vanity Bag SA complies fully with the Consumer Protection Act of South Africa.

While we gladly supply and ship to all countries outside of South Africa, We are not liable nor do we hold ourselves responsible for foreign countries import requirements, and cannot accept parcels  that are returned or destroyed due a foreign countries import restrictions or laws. Should such parcels be returned to The Vanity Bag SA no refunds can be made under such conditions.

You must contact us for any items that need to be returned. Returns that are not authorized may experience delays in processing.
Returns that are received with proper authorization will be refunded or credited to your account as soon as possible after receipt. Refunds that qualify will be processed and may take up to 10 business days to appear on your statement depending on your financial institution. When the refund is processed, you will receive an email notification from The Vanity Bag SA for your records.
Please note that original shipping charges are not refundable and that return shipping charges are the customer’s responsibility except in the case of carrier damage or an error by The Vanity Bag SA.

Refunds may carry a 5% fee as per cancellation of orders e.g. for incorrect items ordered and a refund requested, this is to cover our processing costs such as bank transaction charges etc. However, should you wish your account to be credited the sales amount will not be subject to a cancellation fee however shipping fees in all cases are non-refundable.

5.         Damaged in transit
We take extreme care to ensure the goods & product are packaged securely to arrive in excellent condition. Any claims for carrier damaged items or product must be submitted to us within 7 business days after receipt of your delivery. To ensure a prompt resolution to your situation, please return the box, packing materials, and the damaged items to The Vanity Bag SA. Any refund or re-ship will be processed following inspection of the product. A photo of the damaged goods or product can be sent to the company via email to  thevanitybagsa@gmail.com or via text message or WhatsApp to +2782 355 9555

  1. Allergic Reactions
    It is always important to use products as directed on the label, but in the extreme, case your skin becomes irritated or shows signs of an allergic reaction, stop using the product immediately and contact us to speak to one of our skin therapists (no later than 14 days from purchase date). If our skin therapist identifies that the product purchased caused an adverse skin reaction we will adhere to our supplier’s decision as to what procedure must be followed.
  2. Incorrectly Ordered Items, Cancellation of orders and Exchanging of delivered Products
    Incorrectly Ordered Items, Cancellation of orders and Exchanging of delivered Products will be accommodated. Please call us as soon as possible to let us know. The product will need to be returned and received by us in pristine condition, unopened, unused and the packaging not damaged in anyway.

MAKE-UP – Due to the nature of Make-Up products and the many colours and shades we cannot accept these items for return or exchanges, and we request that item colours are checked prior to purchase.

The following fees will be applicable to recover cost and service fees

  1. a) Incorrectly Ordered Items and Cancellation of orders – prior to payment – 0%
  2. b) Incorrectly Ordered Items and Cancellation of orders – prior to shipment but after having made payment – 5%
  3. c) Incorrectly Ordered Items and Cancellation of orders – after packing, shipment and return to The Vanity Bag SA (packaged unopened) – 5% plus shipping costs.
  4. d) Exchanging of delivered Products – the return and reshipping cost will be for the clients account.

  1. Stock Items

Should an item be out of stock for more than 7 days from the date of placement of an order, The Vanity Bag SA will inform the client and the client will have the following options:

1) To wait until the product becomes available and in stock again. The Vanity Bag SA will ship outstanding products “Free of charge” to the client.

2) To cancel the item and have the cost of the item either credited to the client’s account or have the cost of the item refunded into the clients banking account.

3) Credit/Debit Card refunds and reversals are not allowed due to the high cost of the banking charges. We make all refunds into a client current or savings account

4) Should a purchased item be discontinued then client may opt to purchase another similar product or have the product refunded into the clients account or banking account.

As we replenish stock almost on a daily basis from the suppliers – the situation may arise where both the supplier and The Vanity Bag SA are out of stock – In this case the client will be contacted and section 4 above applies.

  1. Account Credits and Refunds

The Vanity Bag SA will gladly refund you when the error is due to the fault of The Vanity Bag SA, However in the case of stock unavailability The Vanity Bag SA will credit your Account with the full amount for you to select and purchase a similar or different item.

  1. Delivery

The Vanity Bag SA uses Fastway Couriers and SAPO (South African Post office) to ship your parcels, The Vanity Bag SA will replace any parcel that is not delivered i.e. that has gone missing (Only within South Africa territory). Parcel tracking numbers are e-mailed to you once the parcel has been shipped with further instructions regarding the delivery if required:

The Vanity Bag SA is not responsible for late deliveries nor does The Vanity Bag SA Guarantee delivery dates or times, as the cause may be out The Vanity Bag SA’s hands, these causes are normally due to incorrect address supplied, delivery vehicle failure, and force majeure events etc.

  1. Specials

The Vanity Bag SA provides clients with a continual flow of specials and discounts, thus making The Vanity Bag SA the first choice of thousands of happy South African’s.

Specials may be from The Vanity Bag SA or from The Vanity Bag SA’s suppliers and may be purchased under the following conditions.

All Specials on The Vanity Bag SA are only made available for a certain period of time and are subject to stock availability. Specials may only be purchased whilst it is being advertised on The Vanity Bag SA and must be fully paid for during this period. The Vanity Bag SA reserves the right not to honour any order that contains expired special deals or discounts.

Should an advertised special become unavailable The Vanity Bag SA reserves the right to replace the special with another at the choice of The Vanity Bag SA.

  1. Loyalty

The Vanity Bag SA offers all clients a loyalty discount. The loyalty Discount is credited to the clients store account after the item has been shipped. This loyalty discount s redeemable as a store credit the next time the client purchases from The Vanity Bag SA.

1) Purchases made by Guests do not qualify for Loyalty Rewards

2) International purchases where the products are shipped outside of South Africa do not qualify for Loyalty Rewards.

NB: Should a client not redeem Loyalty Within a period of one calendar year any Loyalty Rewards are automatically deleted i.e. The voucher must be redeemed within one year of purchase.

13.       Gift Certificates

Gift Certificates may only be used to purchase merchandise and cannot be used to purchase other Gift Certificates or redeemed for cash.. An online store credit will be issued to the gift recipient for the full amount of the merchandise return.

Returning product paid by Gift Certificates will follow point no 7. Incorrectly Ordered Items, Cancellation of orders and Exchanging of delivered Products

The product will need to be returned and received by us in pristine condition, unopened, unused and the packaging not damaged in anyway.  Shipping cost for the return of the product will be the customer’s account
Return of products purchased with a gift certificate, will follow the requirements of The Vanity Bag SA does not offer exchanges or cash refunds for Gift Certificate purchases. Any funds charged to a credit card will be Reimbursed to the client chequing or savings account.

  1. Store Credits

Store credits obtained by customers for whatsoever reason may not be exchange for cash, and may be used to purchase goods from The Vanity Bag SA only.

  1. International Sales

We do deliver to countries outside of South Africa. Customers may place orders for delivery within South Africa that are intended for further shipment to countries outside of South Africa, for the purpose of reselling.

Please contact us in this regard prior making any such purchases. Product Shipment cost outside South Africa will be for the customer’s account. A quote will be provided to the customer for the shipment to the desired destination. The cost of shipment, customs duties, taxes and clearance cost will be solely for the customer’s account.

16.       Limitation of Liability
The Vanity Bag SA shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if The Vanity Bag SA has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

17.       Typographical Errors
In the event that a The Vanity Bag SA product is mistakenly listed at an incorrect price or a product’s specifications are incorrectly advertised, The Vanity Bag SA reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. The Vanity Bag SA reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, The Vanity Bag SA shall issue a credit to your credit card account in the amount of the incorrect price.

18.       Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by The Vanity Bag SA without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

19.       Notice
The Vanity Bag SA may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to The Vanity Bag SA.

20.       Miscellaneous
Your use of this site shall be governed in all respects by local legislation and laws, without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of The Vanity Bag SA products) shall be in the courts of South Africa. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of The Vanity Bag SA products) must be commenced within one (1) year after the claim or cause of action arises. The Vanity Bag SA’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. The Vanity Bag SA may assign its rights and duties under this Agreement to any party at any time without notice to you.

21.       Use of Site
Harassment in any manner or form on the site, social media, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a The Vanity Bag SA or other licensed employee, host, or representative, as well as other clients or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

You agree to indemnify, defend, and hold harmless The Vanity Bag SA, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

In an attempt to provide increased value to our visitors, The Vanity Bag SA may link sites operated by third parties. However, even if the third party is affiliated with The Vanity Bag SA, The Vanity Bag SA has no control over these linked sites, all of which have separate privacy and data collection practices, independent of The Vanity Bag SA. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, The Vanity Bag SA seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
